is certainly the intention of the obama administration. you know, it was certainly their intention the first four years of their administration, as well. but going into the next four years, what has really changed in the last several weeks is the public sentiment has swung so far in their favor in the wake of the newtown shootings. so they realize that they've got a tough fight ahead of themselves. facing a republican-led house of representatives. certainly we've got motivated people on the other side of the argument who are trying to defend what they perceive to be their second amendment rights to bear arms. but with public sentiment having swung the pendulum in the favor of the obama administration's platform and tightened gun control legislation and the specific clauses banning assault rifles and high capacity magazines, i think they're more than motivated now. >> gun sales are up since newtown. up since newtown. does that tell you that investors at least think there's not going to be amainingful decrease in the value of gun manufacturers and in the sale of guns in america? >> w

not technically in recess. the obama administration is pushing back against that, and they are saying that they believe the senate was in recess. why? because they were in a pro forma session which essentially means that there weren't senators here, they weren't conducting official business, but they were gaveling into session every few days. this, of course, occurred during the holidays of 2012. so the obama administration today saying that they strongly disagree with the court's ruling. they maintain that the senate was not in session, was essentially in recess when the president made those appointments. >> of course, many of us have been tempted to believe that even when there are senators and congressional members present, it's not actually functioning, but go on. >> reporter: right. and that is what the obama administration is arguing. that, look, the senate is not really functioning during these pro forma sessions. but in terms of whether the obama administration will appeal this, that is still a big question mark. the justice department has not weighed in yet, martin. however,

obama administration is trying to take a step further. the clinton administration privatized it in the processing, you know, meat -- animals are slaughtered, and then they're sent to another step where they're cut up and processed and packaged. so in the processing there's been this privatized system that we've done a lot of work showing how dangerous it is at food and water watch. now the obama administration wants to increase this program especially for poultry, and it would mean that more than 200 birds a minute are being sent, are being slaughtered in a plant. that's not a misstatement, 200 birds a minute. they whiz down the line, there's no way that there can be any inspection of these carcasses. and these are immigrant workers. it's extremely dangerous work. you can imagine people's hands get sliced, people -- all sorts of horrible injuries. and then because of all of the contamination from salmonella, i mean, really, i can't -- i can never eat another piece of chicken. they dip the chicken into chemicals, things like chlorine and trisodium phosphate, and that really originated w
